Nature of Commercial Debt Recovery
Commercial debt recovery concerns the recovery of unpaid sums arising in a business context. The debt may arise under a contract, an unpaid invoice, a loan arrangement, a guarantee or a course of dealing between businesses or individuals. Although some debts are straightforward and undisputed, others involve disagreement about liability, the quality of goods or services supplied, set-off, payment terms or the proper construction of the underlying agreement. For that reason, debt recovery often involves more than simply sending a demand and issuing a claim.
Debt recovery proceedings may include statutory demands, County Court claims and enforcement action. The appropriate route depends on the size and nature of the debt, whether the debt is genuinely disputed, the financial position of the debtor and the practical objective of the creditor. In some cases, carefully structured pre-action correspondence is enough to secure payment or settlement. In others, formal proceedings are required.
